These general terms and conditions govern the contractual relationship between SEGURIDAD AEROPORTUARIA SL (hereinafter, “Supplier”) and the client company (hereinafter, “Client”) for the provision of services.

The purpose of this document is to establish the general terms and conditions (GTC) between the training provider and the user, whether a natural or legal person (hereinafter referred to as the CLIENT), who freely wishes to contract the ONLINE training services. These terms and conditions regulate the use of the training services purchased, whether through the online store for which SEGURIDAD AEROPORTUARIA SL is legally responsible.
These GTC also apply to those who are registered and receive training (USER), even if they are not the same as the CUSTOMER, for example because the contract has been established between a legal entity for the training of its employees.

CLIENT


The CLIENT, whether a natural or legal person, warrants that they have the legal capacity to enter into this contract.
In the event that the contract is entered into with a legal entity, which in turn requests training services for its employees, it undertakes to communicate these GTC to them, as well as to inform them of and have them accept the LEGAL CONDITIONS, PRIVACY POLICY, and COOKIE POLICY that appear on the training platforms owned by SEGURIDAD AEROPORTUARIA SL and that the USER.

COVERAGE of our services


The use of this web platform, as well as any transaction carried out through it, is considered to have been made in Spain and, therefore, is subject to current Spanish laws and regulations, without prejudice to the legislation that may be applicable depending on the user’s status. B2B Customer refers to commercial companies and self-employed professionals who carry out a professional activity and do not have the status of consumer according to Article 3 of the General Law for the Defense of Consumers and Users. By accepting these conditions and/or purchasing services, the B2B Customer guarantees SEGURIDAD AEROPORTUARIA SL that they do not have the status of consumer according to the aforementioned article.

PURCHASE TERMS AND CONDITIONS


CUSTOMERS who make payments on the Platform via PayPal accept the legal agreements for PayPal services.
Likewise, if the customer makes the payment on Stripe platforms, Woocommerce accepts the legal agreements for these services.
The CLIENT undertakes to observe and strictly comply with the clauses indicated on the Platform, as well as any applicable legal provisions.
The CUSTOMER declares that they have full capacity to use credit/debit cards.
The purchase price will be charged to your card account immediately.
In the event that the POS (Point of Sale) terminal reports that the card has been declined, the registration will be automatically canceled, and the customer will be informed of this cancellation online.
Contracts negotiated with legal entities shall be governed by the payment terms established therein. If no such terms are established, a bank transfer shall be made no later than 7 calendar days after the contract is signed.
For anything not specifically negotiated with legal entities, the provisions of these GTC shall apply.
The SUPPLIER reserves the right to change these general terms and conditions at any time, and it is therefore the responsibility of the CUSTOMER to review them before purchasing any products or services available on the Platform.
The contractual relationship shall be terminated upon delivery of the certificates of achievement, or after two unsuccessful attempts to pass the exam, and once the corresponding fee has been paid.
In the event that the contractual relationship remains in force, the SUPPLIER shall notify the CUSTOMER individually in the event of any substantial changes to these general terms and conditions.

Ordering process. How can I buy online?
In order to access the services offered by SEGURIDAD AEROPORTUARIA SL and make a purchase, you must freely and voluntarily provide the personal data that will be requested.

Course Access and Delivery


Once the contracting company has completed the purchase of the course for its employees, the student will have immediate access to our learning platform using their registration credentials (email and password).
Once the customer has provided the students’ names: full name, ID number, and email address, which are required for enrollment, the process is considered to have begun and no deletions, changes, or cancellations will be accepted, with the exception of the right of withdrawal, as indicated below.
Once they have passed the OFA exam, students will be presented for the official AESA exam by SEGURIDAD AEROPORTUARIA S.L. as an Authorized OFA.
The student will have two opportunities to take the exam before AESA. If they fail on both occasions, with some exceptions, they must pay the corresponding fee to reopen their enrollment (never exceeding the price paid for the course in the initial enrollment).
The student will not be able to download their training certificate until AESA notifies OFA of a “PASS” grade.
The PROVIDER is not responsible for any delays caused by the purchaser entering incorrect student data. The mandatory data for enrollment are:
• STUDENT’S FIRST AND LAST NAMES.
• STUDENT’S EMAIL ADDRESS.
• STUDENT’S ID/NIE or passport number.
The data recorded by SEGURIDAD AEROPORTUARIA SL constitutes proof of the transactions made between the Website and customers, and of the contractual obligations generated by both parties.
SEGURIDAD AEROPORTUARIA SL will confirm your order by sending an email with the course access details to the email address registered in the student’s email field.

The invoice will be issued in the name of the student or another company name chosen by the CUSTOMER. To do this, you must choose who to invoice and, if it is another company, you must correctly fill in the fields on the form dedicated to INVOICING. SEGURIDAD AEROPORTARIA S.L. reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of order registration, except in the case of obvious typographical errors. However, once the contract has been formalized, the price provided will not be modified.
Temporality: payment for a course entitles the student to access the training platform to complete the selected course during the established period of 30 days. Course access rights include two attempts to take the final assessment test. If the two attempts are not passed, the student may have extra assessment attempts, which will be subject to a fee that will never exceed the price paid for the initial course registration.
The information offered about the products or services available on the Platform could contain some typographical error beyond the control of Formación Jurídica. In this case, it will be corrected immediately. If the typographical error refers to the prices and the Client has proceeded to contract any of them as a result of the error, they will be notified immediately and they will be empowered to terminate their contract without any cost.
The CLIENT must be responsible for ensuring that the data entered is correct. If the data appears incorrectly in the certificate due to an error by the CLIENT when providing the data, it may cause a delay in the new issuance of the certificate, without prejudice to a possible surcharge for the associated costs.
If the client is a company, and unless otherwise stated, SEGURIDAD AEROPORTUARIA SL may use its logo to inform on its website or social networks of the established commercial relationship, and may revoke said permission at any time.
Within the platform, the student will find all the material necessary for training, including documents, presentations and additional resources. Besides.
To keep both our clients and the student up to date with any news or updates related to the course, we will send them notifications by email. This includes information about new sessions, material updates, and any other relevant news that may enhance the learning experience.


Offer and acceptance


The contracting procedure and pre-contractual information is in Spanish. This is the language that will be used to carry out the contract. If it can be carried out in another language, it will be indicated before starting the contracting procedure.


Information on payment methods


Payment of the price through the website is made at the time of purchase and SEGURIDAD AEROPORTUARIA SL will send you an email confirming the purchase made.

SEGURIDAD AEROPORTUARIA SL states that it does not have access to or store sensitive data related to the payment method used by the User, except for those strictly necessary for its management. In the context of the acquisition of our training courses, eventualities may arise that affect the delivery process. Although our courses are delivered virtually and immediately after purchase, circumstances may arise that make it difficult for the user to access the content.

These problems may include, but are not limited to, temporary technical difficulties in the learning platform, interruptions in the user’s Internet service, or any other eventuality beyond our responsibility that prevents proper access to the course content.

In the event that the user experiences difficulties accessing the course after purchase, we are committed to providing timely technical support to resolve any inconvenience. In addition, we are committed to providing alternative access to the content in the event of unforeseen technical problems.


GUARANTEE of conformity


SEGURIDAD AEROPORTUARIA SL guarantees that the services provided will conform to the agreed specifications and will comply with the applicable quality standards. If any non-compliance is detected, the Client must notify SEGURIDAD AEROPORTUARIA SL in writing, providing a detailed description of the problem and any relevant evidence. This notification must be made within a reasonable period of time from when the breach is detected.
Once the notification is received, SEGURIDAD AEROPORTUARIA SL undertakes to:
Assess the problem and confirm non-compliance.
Correct defective services at no additional cost to the Client.
Provide an alternative solution if correction is not possible within a reasonable time.
This warranty does not cover:
Defects or non-compliance resulting from modifications not authorized by SEGURIDAD AEROPORTUARIA SL.
Problems caused by the improper or inappropriate use of the services by the Client.
Non-compliance due to circumstances beyond the control of SEGURIDAD AEROPORTUARIA SL, such as natural disasters or interruptions in the supply of external services.
To preserve the confidentiality of the data and the business relationship, any information exchanged during the complaint and correction process will be treated confidentially by both parties.

PAYMENT SECURITY

RETURN POLICY


Once the affiliation data indicated for the students has been provided and in the event that the payment has not been made previously, the obligation to pay the economic rights established in the agreement will be generated, including the corresponding VAT, for which SEGURIDAD AEROPORTUARIA SL will issue the corresponding invoice.
When contracting with legal entities, it will not be accepted in any case and unless expressly agreed that the registered persons belong to another entity or legal person (Third Parties).
Without prejudice to what is established in the following chapter in reference to the rights of consumers and users, for those legal entities that are not consumers and users, and unless expressly agreed, withdrawal, rectification or cancellation of registered students will not be admitted once the data for their registration has been provided.
Each course has an established deadline for completion at the time of the Client’s enrollment in it. The deadline for completing an edition of a course is the period of time that elapses between the start date and time, and the end date and time of the course.
In the event that the course does not establish such a period, it is considered by default to be 30 calendar days.
The Client enrolled in a course edition expressly accepts the start date and time, and the end date and time of the course edition. During the course completion period, SEGURIDAD AEROPORTUARIA SL provides the Client enrolled in a course with Internet access to the digital content of the course.
Once the period for completing a course has elapsed, it will be understood that SEGURIDAD AEROPORTUARIA SL has fulfilled what was contracted with the CLIENT, regardless of whether or not the CLIENT accesses it.

Specific clauses for consumers and users


Consumers or users are natural persons who act for a purpose unrelated to their commercial, business, trade or profession. Legal persons and entities without legal personality that act without profit motive in an area other than a commercial or business activity are also consumers for the purposes of this rule.

In the event that the CLIENT is a consumer or user, the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws (LGCU), will apply.
The USER of the service will not in any case be a consumer or user in accordance with the aforementioned law, when the CLIENT with whom the contract has been established is a legal entity, even when the person carrying out the training is a natural person.
A self-employed worker is also not considered a consumer or user according to the legal definition of said figure.
The right to withdraw from a contract is the right of the consumer and user to cancel the concluded contract, thus notifying the other contracting party within the period established for the exercise of that right, without the need to justify their decision and without penalty of any kind.
Except for the exceptions provided for in article 103 LGCU, the consumer or user will have the right to withdraw from the contract during a period of fourteen calendar days without indicating the reason and without incurring any costs other than those provided for in articles 107.2 and 108.
With the exception indicated below, you may exercise your right of withdrawal and SEGURIDAD AEROPORTUARIA SL. undertakes to refund the full amount of the purchase made within a maximum period of 14 calendar days counting from the communication of your desire to withdraw, by email, to the email: info@seguroaeroportuaria.com. This right of withdrawal can only be exercised as indicated below if the training action has not started.
Article 103 of the LGCU includes exceptions to the right of withdrawal, among which: “The supply of digital content that is not provided on a material medium when the execution has begun with the prior express consent of the consumer and user with the knowledge on their part that they consequently lose their right of withdrawal.”
Once the consumer has provided their registration information and the SUPPLIER has provided the access codes to the training platform, the execution must be considered to have begun and therefore cannot be canceled or withdrawn.
The acceptance of these general contracting conditions entails a formal acceptance that once the CONSUMER RECEIVES THE ACCESS KEYS TO THE PLATFORM he will lose his right to withdrawal.
In this way we inform you that you are excluded from the right to withdrawal if the person enrolled in the course accesses the training platform using the credentials that authorize them to do so (Username and Password).
Likewise, the right of withdrawal is excluded in AVSAF courses with an official exam by the Spanish Aviation Safety Agency (AESA) since in these cases the external process of student registration is carried out on the AESA external platform and its cancellation is not possible in these cases.

Right of withdrawal


In the context of commercial relations between companies (B2B), the right of withdrawal is not regulated in the same way as in relations with end consumers (B2C). However, SEGURIDAD AEROPORTUARIA SL recognizes the importance of offering flexibility and transparency to our business clients.
The buyer (company) will have a period of 14 calendar days from the date of purchase of the course to withdraw from the contract without the need for justification.
To exercise the right of withdrawal, the contracting company must notify its decision to withdraw from the contract through the following email info@seguroaeroportuaria.com.
In the event of withdrawal by the contracting company, all payments received will be refunded, including delivery costs (with the exception of additional costs resulting from the purchasing company’s choice of a delivery method other than the least expensive ordinary delivery method offered) without any undue delay and, in any case, no later than 14 calendar days from the date on which the decision to withdraw from this contract is informed.
The refund will be made using the same payment method used by the contracting company for the initial transaction, unless otherwise expressly provided; In any case, you will not incur any costs as a result of the refund.

The right of withdrawal will not be applicable in the following cases:
When the training course has been completely executed, if the execution began with the prior express consent of the contracting company and with its recognition that it is aware that, once the contract has been completely executed by our company, it will have lost its right of withdrawal.
When the training course consists of digital content that is not provided on a material medium, if the execution has begun with the prior express consent of the purchasing company and with its recognition that it consequently loses its right of withdrawal.


Technical problems


SEGURIDAD AEROPORTUARIA SL guarantees to the CLIENT that it will carry out all the actions within its power for the correct functioning of the Platform. However, taking into account that the operation of the Platform could depend on the intervention of third parties, SEGURIDAD AEROPORTUARIA SL is not responsible for any inconveniences that may be caused to the Client due to its incorrect operation.
Course Not Completed: If the Client does not complete a course due to justified causes, such as severe technical problems that originate on the SEGURIDAD AEROPORTUARIA SL platform, only in the event that the cause is the SUPPLIER, it will be possible to reschedule access to it at no additional cost. The Customer must notify Customer Service of the situation within a reasonable period of time from the occurrence of the problem, providing details of the technical difficulty experienced.
Technical Problems: In the event that technical problems occur on the SUPPLIER’s platform that prevent full access to the course after the purchase, SEGURIDAD AEROPORTUARIA SL undertakes to provide technical assistance and alternatives so that the Client can access the contents. If the problems are irreparable after 10 days and significantly affect the availability of the courses, the Client may choose to receive a full refund of the amount paid except for courses already completed where the corresponding certificates of completion have been given.


SERVICE PROVISION and lack of places.

The content of the courses is the property of SEGURIDAD AEROPORTUARIA SL, registration and payment of the same gives the right of use during a specific period of time for each course and its start is stipulated at the time of registration for the course. After the stipulated period of time, the user will not be able to access the course contents. If not expressly indicated, the maximum period to complete the course is 30 calendar days

SEGURIDAD AEROPORTUARIA S.L., reserves the right to reject the registration of any new user and in particular with those with whom it has a dispute.

AIRPORT SECURITY S.L.,. will do everything possible to please all its clients in the demand for the courses.

In case of unavailability of a course after payment has been made, the client will be informed by email of its cancellation.

The speed in which the amount is returned to the client’s bank account will depend on the type of bank card and the conditions of each bank, with a maximum of 15 calendar days.

The courses that require an official exam depend on the agility with which the competent administration (AESA) carries out the procedures, an aspect that the CUSTOMER must take into account when receiving the corresponding certificate, especially on holidays.

In the event that all the places in the course are sold out, our Customer Service will contact you as soon as possible, using the contact methods provided during the purchase process. We are committed to keeping you informed in a timely and transparent manner about the situation.

In this circumstance, SEGURIDAD AEROPORTUARIA SL undertakes to make a full refund of the purchase amount immediately and, in any case, without undue delay. The refund will be made using the same payment method used in the original transaction, unless otherwise expressly agreed.

Additionally, we will offer you the option to receive notifications about the future availability of the service, so that you can purchase it as soon as it is available again.

 
Responsibility


The responsibility of SEGURIDAD AEROPORTUARIA SL in relation to the training courses is limited to providing access to the content and services described in our offers and to ensuring that these meet the agreed quality standards.

SEGURIDAD AEROPORTUARIA SL will not be responsible for:
Indirect, incidental, special or consequential damages that may arise from the use or inability to use our training courses.
Losses of profits, revenue, data or data use, even if we have been informed of the possibility of such damages.
Technical problems, Internet service interruptions, or any other circumstance beyond our control that prevents proper access to the courses.

The CUSTOMER is responsible for:
Provide the correct and complete data necessary for registration and access to the courses.
Ensure your equipment and software are compatible with our platform.
Use the contents of the courses appropriately and in accordance with the established conditions of use.
Customer authentication will consist of your username, email address and a password. To access the Client’s own account, it will be necessary to include this username, as well as a password.
The use of the password is personal and non-transferable, and transfer, even temporary, to third parties is not permitted. In this sense, the Client undertakes to make diligent use and keep it secret, assuming all responsibility for the consequences of its disclosure to third parties.
In the event that the Client knows or suspects the use of his password by third parties, he must modify it immediately, in the manner in which it is collected on the Website. SEGURIDAD AEROPORTUARIA SL will not accept responsibilities if the previous requirement has not been met.

Our company will not be responsible for failure to comply with its contractual obligations when such failure results from force majeure events, such as natural disasters, labor disputes, interruptions in the supply of external services, or any other circumstances beyond our reasonable control.

In the event of any dispute related to the provision of our services, both parties undertake to try to resolve it amicably and in good faith. If an agreement is not reached, the parties may resort to the competent courts according to the applicable jurisdiction.


MINORS


SEGURIDAD AEROPORTUARIA SL directs its services exclusively to users over 18 years of age. Minors under this age are NOT authorized to use our services and should not, therefore, send us their personal data. SEGURIDAD AEROPORTUARIA SL does not assume any responsibility in the event that minors try to access or use the service in an unauthorized manner. For appropriate purposes, parents or legal guardians are urged to supervise the online activities of minors and ensure that they do not use this service without proper authorization.

CODE OF HONOR IN TRAINING


By enrolling in a course, the CLIENT agrees to adhere to this Honor Code.

The CLIENT must carry out all evaluations and tasks independently, except in those cases where it is expressly indicated that collaboration is allowed.

The CUSTOMER must maintain only one user account and must not allow any other person to use his or her username and password to access the platform.

The CLIENT is prohibited from participating in any activity that could undermine the integrity of the evaluation, either by dishonestly benefiting himself or herself or affecting the results of others.

The CLIENT must not share the answers to the evaluations and tasks that are used to evaluate their performance in the course.

The CLIENT must perform the tasks avoiding plagiarism of third party content and must not allow others to plagiarize their work to complete theirs.

Any breach of this Honor Code by the CLIENT may result in non-approval of the course, without the right to a refund of the amount paid.

Confidentiality and Non-Disclosure Agreements

Both parties agree that all confidential information exchanged during the term of the contract, including, but not limited to, commercial, technical, financial data, and any other information that is identified as confidential, will be treated with the utmost confidentiality.

Each party agrees to:
Not disclose, share or make available to third parties confidential information received from the other party without the prior written consent of the disclosing party.
Use confidential information only for the purposes established in the contract and not for any other purpose.
Take appropriate measures to protect confidential information from unauthorized access, disclosure or misuse.

Confidentiality obligations will not apply to information that:
Is in the public domain at the time of disclosure or becomes public domain without breach of this Agreement by the receiving party.
Is known to the receiving party prior to its disclosure by the disclosing party, provided that such information is not subject to a prior confidentiality agreement.
Is disclosed to the receiving party by a third party who has the right to do so without confidentiality restrictions.
Whether required by law or court order, provided that the receiving party provides sufficient notice to the disclosing party to allow the disclosing party to take appropriate steps to protect the information.

The confidentiality obligations set forth in this agreement shall remain in effect during the term of the agreement and for a period of two (2) years after its termination, unless otherwise agreed in writing.

Upon termination of the agreement, each party agrees to return or destroy, as requested by the disclosing party, all confidential information received, including any copies thereof, in any format.

Failure to comply with confidentiality obligations by either party will entitle the injured party to claim damages, as well as to request injunctive relief to prevent or stop any unauthorized use or disclosure of confidential information.

Conflict Resolution


Applicable law and jurisdiction
The relationship between SEGURIDAD AEROPORTUARIA SL and the Consumer and User will be governed by current Spanish regulations. In accordance with the provisions of article 90.2 of the TRLGDCU, all disputes and claims arising from this legal notice will be resolved by the Courts and Tribunals of the consumer’s domicile.
Extrajudicial conflict resolution

Intellectual property


All intellectual and industrial property rights over the content, materials, and resources provided in the courses taught by SEGURIDAD AEROPORTUARIA SL, including, but not limited to, texts, graphics, images, videos, software, and any other material, are the exclusive property of SEGURIDAD AEROPORTUARIA SL.
The Customer receives a non-exclusive, non-transferable, and limited license to access and use the contents of the training courses exclusively for the internal training purposes of its employees. This license does not grant the Customer any ownership rights over the contents.
The Customer agrees not to:
Reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any content from the courses, except as expressly permitted in this clause.
Allowing third parties to access course content without the prior written authorization of SEGURIDAD AEROPORTUARIA SL
Using course content for any commercial purpose other than the internal training of your employees.
The Customer undertakes to respect and protect the intellectual property rights of SEGURIDAD AEROPORTUARIA SL and to immediately notify any unauthorized use or infringement of such rights. SEGURIDAD AEROPORTUARIA SL reserves the right to take the necessary legal measures to protect its intellectual property rights.
Failure by the Customer to comply with the obligations set forth in this clause shall entitle SEGURIDAD AEROPORTUARIA SL to terminate the contract immediately and to claim damages for any infringement of its intellectual property rights.
